1. Acceptance of Terms
By creating an account on Inklusif or using any part of the platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not create an account or use the platform.
2. Platform Description
Inklusif is an employment platform connecting OKU (Orang Kurang Upaya — Persons with Disabilities) job seekers with inclusive employers and support organisations in Malaysia. The platform provides AI-powered job matching, inclusive job posting tools, and a consent-based profile sharing system.
3. User Accounts
- You must be 18 years or older to create an account
- You must provide accurate and truthful information during registration
- You are responsible for maintaining the security of your account credentials
- One account per person — sharing accounts is prohibited
- You must notify us immediately if you believe your account has been compromised
4. Job Seeker Terms
- You may only submit genuine applications to jobs you sincerely intend to pursue
- The information in your profile, including disability type and experience, must be truthful and accurate
- Your OKU card number is collected solely to verify eligibility — it is not shared with employers
- You control which support organisations can view your profile via the consent system. Granting consent is always voluntary
- You may withdraw consent from any support organisation at any time from your Settings page
5. Employer Terms
- Job postings must be for genuine, current vacancies
- Job descriptions must not contain discriminatory language or requirements that exclude OKU candidates without legitimate operational necessity
- You agree to consider all qualified applicants fairly and without bias
- Candidate data viewed through the platform must not be used outside the platform for any purpose other than the stated recruitment
- You must not retain candidate data after a recruitment process concludes beyond what is legally required
6. Support Organisation Terms
- You may only access job seeker profiles with explicit, freely given consent
- Profile data accessed through the consent system must be used solely for employment support purposes
- You must not share job seeker data with third parties
- Your referral code must only be shared with individuals who have an existing support relationship with your organisation
7. Prohibited Conduct
The following are strictly prohibited:
- Posting false or misleading job listings
- Submitting fraudulent or insincere applications
- Attempting to access data you are not authorised to view
- Using the platform for harassment or discrimination of any kind
- Automated scraping or bulk data collection
- Attempting to reverse-engineer the AI matching algorithms
- Creating multiple accounts to circumvent restrictions
- Impersonating another person or organisation
8. Intellectual Property
The Inklusif platform — including its AI matching technology, Guardian AI inclusive language checker, interface design, and branding — is owned by Inklusif Sdn Bhd. User-generated content (profiles, job descriptions, messages) remains the property of its creator. By submitting content to the platform, you grant Inklusif a limited licence to display and process that content for the purpose of providing the service.
9. Limitation of Liability
Inklusif provides the platform on an "as-is" basis. We do not guarantee specific employment outcomes, the accuracy of AI matching results, or the conduct of other users on the platform. To the maximum extent permitted by Malaysian law, Inklusif is not liable for any indirect, consequential, or incidental damages arising from use of the platform.
10. Termination
We reserve the right to suspend or permanently terminate accounts that violate these terms, without prior notice. You may delete your account at any time from Settings → Account → Delete Account. Upon deletion, all personal data will be permanently removed within 30 days, in accordance with our Privacy Policy.
11. Governing Law
These Terms of Service are governed by the laws of Malaysia. Any disputes arising from or related to these terms or the use of the platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Changes to Terms
We will notify registered users of material changes to these Terms at least 14 days in advance via in-app notification. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
